The purpose
of a Durable Power of Attorney is to give
another person the right to act for you
in various financial situations. The Power
may be limited, such as the right to represent
you and sign documents in your name only
for the purchase or sale of a specific piece
of real estate, or it might be unlimited
in which case you would give that person
the right to handle any or all of your financial
affairs during your lifetime.
A Durable Power
of Attorney is especially important in Estate
Planning for it gives the person you have
chosen the authority to handle your financial
matters, not only in good times during your
lifetime, but also for your benefit if you
should become disabled, incapacitated or
incompetent due to illness. The appointment
of an agent under a Power of Attorney while
you are in good health might very well avoid
the need of a Court appointed Guardian should
you later suffer from a catastrophic illness
or period of incompetence.
